Judgment

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 19/09/2023 PRESENT The Hon`ble Mr.Justice G.ILANGOVAN Kannan ... Petitioner / Accused No.1

Vs State represented by The Inspector of Police, Samayapuram Police Station, Trichy District Cr.No.276 of 2023. ... Respondent/Complainant For Petitioner : M/s.T.Lenin Kumar

Advocate. For Respondent : Mr.B.Nambiselvan

Additional Public Prosecutor PETITIONS FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.276 of 2023 on the file of the Respondent police. ORDER : The Court made the following order :- The petitioner/ Accused was arrested and remanded to judicial custody on

30.08.2023 for the offences under Sections 3 and 25(1B)(a) of Arms Act, 1959, in Crime No.276 of 2023, on the file of the respondent police, seeks anticipatory bail.

¶2The case of the prosecution is that on 30.08.2023 at about 5.00 p.m., when the police team went for patrol duty, they found the petitioner in suspicious manner and on search they found the petitioner in possession of country made unlicensed gun. Based upon the occurrence, a case was registered and the petitioner was arrested.

¶3Seeking bail on the ground that earlier, the petitioner was arrested and remanded to custody for a simple issue of taking the pilgrims to the temple. Now he has been wrongly roped in this case only on the basis of the previous case. Recovery has been made only against the third accused and not from the petitioner.

4.Heard the learned Additional Public Prosecutor.

¶5But reading of the FIR, does not indicate the fact narrated by the petitioner. Actually unlicensed gun recovered only from the petitioner and the petitioner is also facing several cases. Eventhough some of the cases have already been disposed, considering the bad antecedents, this court is not inclined to grant relief to the petitioner. If he is released on bail, he may abscond.

¶6Accordingly, this Criminal Original Petition is dismissed.
