ORDER This revision has been filed to set aside the conviction and sentence made in C.A.No.53 of 2016 dated

09.04.2018 on the file of the learned Additional District and Sessions Judge (Fast Track Court), Kumbakonam, confirming the Judgment made in S.T.C.No.386 of 2006, dated

06.10.2016, on the file of the learned I Additional District Munsif cum Judicial Magistrate, Kumbakonam.

2.The learned counsel appearing for the petitioner and the learned counsel appearing for the respondent would submit that while pending the appeal, the petitioner/accused and the respondent/complainant died.

3.In view of the above, the entire conviction and sentence as against the petitioner is abated and the Criminal Revision Case is dismissed as abated. However, the legal heirs of the deceased respondent is permitted to withdraw the amount, which was already deposited by the deceased petitioner to the credit of the trial Court.
