O R D E R This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to hand over the original sale deed dated

29.07.1981 bearing Document No.1344 of 1981, deposited under the registered mortgage deed dated 29.03.1998 bearing Document No.535 of 1988, on the basis of the petitioner's representation dated 15.06.2026 and in view of the discharge receipt dated 18.01.2021 bearing Document No.140 of 2021.

¶2Heard the learned counsel appearing for the petitioner and Mr.C.Deepak, learned Additional Government Pleader, who accepts notice on behalf of the respondents.

¶3By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

¶4The learned counsel appearing for the petitioner would submit that the petitioner had availed a loan from the second respondent-Bank by mortgaging the aforesaid documents. Thereafter, the petitioner had discharged the entire loan amount. However, despite such discharge, the original documents have not been released to the petitioner. He would further submit that the petitioner has submitted a representation dated 15.06.2026 to the second respondent seeking return of the original sale deed. However, the said representation has not been considered till date, which constrained the petitioner to approach this Court by filing the present Writ Petition.

¶5The learned Additional Government Pleader appearing for the respondents would submit that, if the petitioner has discharged the entire loan amount, the second respondent-Bank will release the original document in favour of the petitioner, after obtaining the necessary No Objection Certificate and upon completion of the requisite formalities.

¶6In view of the above submission, the second respondent is directed to consider the petitioner's representation dated 15.06.2026 and, if the petitioner has discharged the entire loan amount and there is no other subsisting liability or impediment, release the original sale deed dated 29.07.1981 bearing Document No.1344 of 1981, deposited under the registered mortgage deed dated 29.03.1998 bearing Document No.535 of 1988, in favour of the petitioner, after obtaining the necessary No Objection Certificate and completion of the requisite formalities, within a period of four weeks from the date of receipt of a copy of this order.
