Judgment

O RDER

This petition is filed under Section 482 of Cr.P.C. seeking for quashment of FIR in Crime No.16 of 2019, dated 02.12.2019, pending on the file of the first respondent Police registered against the petitioner for the offence under Sections 498(a), 323 and 506(1) of I.P.C.

¶2When the matter was taken up for hearing, learned Additional Public Prosecutor submits that the Police have completed the investigation and charge sheet is also filed before the concerned Magistrate Court, however, the said charge sheet was returned with some objections and the respondent Police are resubmitting by complying the objections.

¶3Once investigation has already been completed and charge sheet has been filed, cause does not survive for the petitioner to proceed with the case.

¶4Accordingly, this Criminal Original Petition is disposed of, with a liberty to the petitioner to challenge the charge sheet once it is taken on file by the learned Magistrate concerned. Consequently, the connected miscellaneous petition is closed.
