ORDER This Writ Petition is filed under Article 226 of the Constitution of India seeking for a direction to the respondent police to dispose of the representation dated 09.08.2023 lodged against Prince Asariya.
2.It is submitted by the learned counsel for the petitioner that on
29.11.2021, the petitioner's son, by name Suresh was abducted by Prince Asariya and got executed a sale deed forcibly and a complaint stated to have been given earlier, but no action has been taken. A fresh representation was given on
09.08.2023, but the action still has not been taken, thereby sought for suitable directions.
3.The learned Government Advocate (Crl.side) submits that basing on the representation, an enquiry was conducted. The petitioner herself appeared before the respondent police on 21.08.2023 and she has withdrawn the complaint. It is submitted further that on a complaint given by Prince Asariya, a case has been registered against the petitioner's son and daughter-in-law in Crime No.6 of 2023 by CCB Police and the investigation is still pending. Further, this petition is filed not by the petitioner's son, who was forced to execute the document, but the petitioner's mother and no explanation is offered as to why the petitioner's son has not filed any complaint.
4.Since the police have already closed the complaint dated 09.08.2023 and instead of the petitioner's son, the petitioner has filed this petition, no further orders can be passed in this petition and accordingly, this Petition is disposed of. No costs.
