Judgment

ORDER This petition has been filed seeking for a direction to the respondents 1 and 2 to take appropriate legal action against respondents 3 and 4 and provide adequate police protection to enable the petitioner to put up a fence / compound wall around his property upon the petitioner's representation dated 22.07.2026, within any time stipulated by this Court.

¶2The learned counsel appearing for the petitioner submitted that the survey of the aforesaid land has already been conducted by the revenue authorities. Based on the survey, when the petitioner tried to put up a fencing, it was obstructed by the private respondents, and hence, the petitioner made a representation to the respondent police. The same is not attended and hence, this writ petition came to be filed.

¶3Heard the learned counsel appearing on either side and perused the materials placed before this Court. Considering the nature of the order proposed to be passed in this petition, notice to the private respondents is dispensed with.

¶4Considering the facts and circumstances of the case, the respondent police are directed to issue notice to the petitioner as well as the private respondents under Section 64 of the BNSS, and afford an opportunity of hearing to both parties.

¶5The petitioner is also directed to furnish all necessary particulars along with the survey report to the respondent police. Thereafter, if the petitioner's claim is found to be genuine, the respondent police shall provide necessary police protection, subject to payment of the requisite fees in terms of G.O. Ms. No. 139, Home (Pol-VIII) Department, dated 04.03.2019, and facilitate the petitioner to fence the property in question. The entire exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.

¶6With the above direction, this writ petition stands disposed of.
