Judgment
O R D E R Challenging the impugned proceedings dated 13.01.2025 passed by the third respondent, the present writ petition has been filed.
¶2Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3The learned counsel appearing for the petitioner would submit that the petitioner is running a small-scale pig farm in his patta land comprised in Survey Nos.501/14, Arumani Village. However, subsequently, the neighbouring residents raised objections before the respondents, pursuant to which the third respondent passed the impugned order directing sealing of the pig farm. Challenging the same, the present writ petition has been filed.
¶4The learned counsel appearing for the petitioner would further submit that this Court may grant liberty to the petitioner to submit an application seeking the requisite licence/permission for running the pig farm within a period of one week and upon receipt of the same, the respondent may be directed to consider and pass appropriate orders within a period of two weeks. Until such application is considered, the respondent may be restrained from taking any further coercive steps against the petitioner.
¶5The learned Additional Government Pleader appearing for the respondent would submit that the petitioner's pig farm has already been sealed on the ground that the petitioner does not possess a valid licence for running the same. However, if the petitioner submits an appropriate application seeking the requisite licence/permission, the same will be considered and appropriate orders will be passed in accordance with law.
¶6In view of the above submissions, without expressing any opinion on the merits of the matter, the petitioner is granted liberty to submit an appropriate application seeking the requisite licence/permission for running the pig farm within a period of one week from the date of receipt of a copy of this order. Upon receipt of such application, the respondent shall consider the same and pass appropriate orders on merits and in accordance with law within a period of two weeks thereafter. It is made clear that this Court has not expressed any opinion on the petitioner's entitlement to run the pig farm or on the validity of the impugned order.
¶7The Writ Petition is disposed of with the above directions. No costs. Consequently, the connected miscellaneous petitions are closed.
