Judgment
ORDER The present petition has been filed by the accused persons in S.T.C. No. 668 of 2026 on the file of the learned Judicial Magistrate Court, Paramakudi, seeking to quash the charge sheet, wherein the petitioners are charged with the offences under Sections 287, 125, 126(2) and 189(2) of BNS, 2023.
¶2A perusal of the charge sheet reveals that the petitioners herein who belong to a organization had unlawfully assembled to celebrate the acquittal of their leader. It is further alleged that all of them have entered into a black colour jeep and they have blocked the public way. They were moving around the road raising and also they were alleged to have burst crackers.
¶3According to the learned counsel appearing for the petitioners, the alleged vehicle has not been seized and they had arrived only to welcome the leader of their organization who were acquitted of the criminal case. He further submitted that the complainant is a police official and none of the witnesses are from the general public.
¶4Heard the learned counsel appearing for the petitioners and perused the materials available on record.
¶5As it could be seen from the charge sheet, the petitioners are said to have unlawfully assembled for celebrating the acquittal of their leader and they are said to have blocked the vehicle and burst crackers. It could be seen from the charge sheet that the vehicle has not been seized and there is no other allegation with regard to damage to any public property.
¶6In such view of the matter, the continuation of the criminal proceedings as against the petitioners will only be an abuse of process of law. In such circumstances, the charge sheet in S.T.C.No.668 of 2026 on the file of the learned Judicial Magistrate Court, Paramakudi, is hereby quashed. Accordingly, this Criminal Original Petition is allowed. Consequently connected Miscellaneous Petition is closed.
