...Petitioner

Vs State of Tamil Nadu rep. by The Inspector of Police, Nangavaram Police Station, Karur District. (Crime No.168 of 2026)

...Respondent/Complainant

For Petitioner : Mr.A.Thiruvadi Kumar

Advocate

For Respondent : Mr.N.Balasubramanian Counsel for State of TN (Crl. Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Cr.No. 168 of 2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 27.05.2026, for the offences punishable under Section 103(1) of BNS, in Crime No.168 of 2026 on the file of the respondent police, seeks bail.

¶2The case of the prosecution is that the petitioner is the son of the deceased. Due to the continuous harassment made by the deceased upon the petitioner's mother, the petitioner allegedly attacked the deceased and committed the murder. Hence, a complaint was lodged and the present case was registered.

3.The learned counsel for the petitioner submitted that petitioner has been in judicial custody since 27.05.2026. The investigation has been completed and the final report has also been filed. The petitioner is not involved in any other criminal case. The learned counsel further submitted that, even as per the FIR, there is an averment that the deceased attempted to attack the petitioner's mother with an aruval. He invited the attention of this Court to the contents of the FIR and submitted that the occurrence took place under those circumstances. Hence, he prayed that the petitioner may be enlarged on bail.

4.The learned counsel appearing for the State (Crl. Side) reiterated the prosecution case and submitted that though the investigation has been completed and the final report has been filed, considering the gravity of the offence, the petitioner is not entitled to the relief of bail. However, the petitioner has no previous case. Hence, he strongly opposed the grant of bail.

5.Heard both sides and perused the materials available on record.

6.Considering the facts and circumstances of the case, particularly the allegation that the petitioner intervened when the deceased allegedly attempted to attack his mother with an aruval, the fact that the petitioner is not involved in any previous criminal case, investigation has been completed and final report was also filed, the petitioner has no previous case and also considering the period of incarceration undergone by the petitioner from 27.05.2026, this Court is inclined to grant bail to the petitioner, subject to the following conditions: [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Kulithalai, and on further conditions that: [b] the petitioner shall report before the learned Judicial Magistrate No.II, Kulithalai, at 10.30 a.m., on all working days, until further orders: [c] the petitioner shall not commit any offence similar to the offence of which he/she is accused, or suspected, or of the commission of which he/she is suspected; [d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 51730]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
