Judgment
O R D E R This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the third respondent to implement the proceedings issued by the 2nd respondent vide O.Mu (A1)/6834/2026 dated 25.06.2026 more fully by restoring back the portion of the house which was locked by the 4th respondent within the time stipulated by this Hon'ble Court.
¶2Heard the learned counsel for the parties.
¶3By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to the fourth respondent is dispensed with.
4.The case of the petitioner is that the petitioner is aged about 79 years and his wife is aged about 74 years. Alleging that the fourth respondent, who is none other than the petitioner's son, had taken away the collection amount of the pharmacy, the petitioner lodged a complaint with the police. Pursuant thereto, the fourth respondent locked one portion of his house. Consequently, the petitioner is unable to access the first floor of his house and is facing an imminent threat from his son/fourth respondent. In this backdrop, the petitioner submitted a complaint under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Pursuant thereto, the second respondent issued proceedings dated
25.06.2026, directing the law enforcement agency to take necessary steps to open the locked portion of the house. However, despite the issuance of the said proceedings, the same has not been implemented till date. Aggrieved by the same, the present Writ Petition has been filed.
¶5Considering the limited scope of prayer, this Court directs the third respondent to implement the proceedings of the second respondent dated
25.06.2026, if not already implemented, within a period of four (4) weeks from the date of receipt of a copy of this order.
¶6With the above direction, this writ petition stands disposed of. No costs.
