Judgment

O R D E R This Writ Petition has been filed for issuance of a Writ of Mandamus directing the respondent herein to dispose of the petitioner's application dated 14/10/2025 filed under section 23(1) of the Maintenance and welfare of the parents and senior citizens Act 2007 as against the 2nd Respondent Mr.R.Rajesh, seeking revocation of the gift deed dated 15/09/2020 registered as document no. 8183/2020 at the office of Joint 4 Sub registrar Madurai South executed by her in favour of the 2nd Respondent and to pass orders on merits in the said application within a time frame.

2.Heard the learned counsel for the parties.

3.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself. Since no adverse order is going to be passed, notice to the second respondent is dispensed with.

¶4The petitioner, a 90-year-old senior citizen, alleges that her son, the second respondent, has neither provided her with physical nor financial support. In this regard, the petitioner submitted a representation dated 14.10.2025 to the respondents, requesting them to take appropriate action against the second respondent. It is submitted that, despite receipt of the said representation, the first respondent has not taken any action thereon. Aggrieved by the inaction on the part of the first respondent, the petitioner has filed the present Writ Petition.

¶5The learned counsel further submitted that it would suffice if this Court issues a direction to the first respondent to consider the petitioner's representation dated 14.10.2025 and pass appropriate orders thereon within a time frame to be fixed by this Court.

¶6Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the representation of the petitioner dated 14.10.2025 and pass appropriate orders on merits and in accordance with law, after providing a reasonable opportunity to the second respondent. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. No costs.
