Judgment
O R D E R Challenging the impugned proceedings dated 13.07.2026 passed by the respondent, the present writ petition has been filed.
¶2Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3The learned counsel appearing for the petitioner would submit that the petitioner and her brother, Davis Prem, are the legal heirs of their father, Gunamanidas. The said Gunamanidas died leaving behind the petitioner and her brother as his only legal heirs. The property belonging to the petitioner's father consists of a ground floor and a first floor. The petitioner's brother is residing in the ground floor, while the petitioner is residing in the first floor. Thereafter, the petitioner approached the respondent seeking transfer of the electricity service connection in their names. However, the respondent rejected the said request by the impugned order. Challenging the same, the present writ petition has been filed.
¶4The learned counsel appearing for the petitioner would further submit that, as on date, the electricity service connection continues to stand in the name of the petitioner's deceased father. Therefore, the petitioner and her brother are facing difficulty in paying the electricity charges. Though the mutation of the revenue records in their names may take some time, the petitioner and her brother, being the only legal heirs of the deceased, are ready to execute a joint indemnity bond and comply with such other formalities as may be required. Accordingly, the learned counsel would submit that this Court may direct the respondent to transfer the electricity service connection jointly in the names of the petitioner and her brother.
¶5The learned Standing Counsel appearing for the respondent has no objection to the said course of action.
¶6In view of the above submissions, the respondent is directed to consider the request of the petitioner and her brother for transfer of the electricity service connection jointly in their names, subject to their executing a consent-cum-joint indemnity bond and complying with the requisite formalities. It is made clear that, upon completion of the mutation of the revenue records in their names, the petitioner and her brother shall produce the updated revenue records before the respondent, enabling the respondent to pass appropriate further orders, if required. The above exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order.
¶7The Writ Petition is disposed of with the above directions. No costs.
