Judgment
ORDER The petitioner is working as a Junior Revenue Inspector in the 3rd respondent Office. The petitioner, with a grievance that his salary due to him has not been paid for the period on 09.10.2024 and 10.10.2024 and from 03.03.2025 to 06.04.2025 and from 23.06.2025 to 13.07.2025, has filed this writ petition, seeking a Writ of Mandamus.
¶2According to the learned counsel for the petitioner, the petitioner's mother fell down and suffered a fracture. In order to take care of his ailing mother, he applied for medical leave on 09.10.2024 and
10.10.2024. However, the same has not been sanctioned by the 1st respondent. The subsequent leave availed by the petitioner from
03.03.2025 to 06.04.2025 and from 23.06.2025 to 13.07.2025 has also not been considered by the respondents. Therefore, the petitioner has filed this writ petition seeking a Mandamus, directing the respondents to disburse the eligible salary due to him for the abovesaid period.
¶3The learned Additional Government Pleader appearing for the respondents, based on the written instructions provided to her by the 3rd respondent, submits that it is true that the salary due to the petitioner on
09.10.2024 and 10.10.2024 and from 03.03.2025 to 06.04.2025 and from
23.06.2025 to 13.07.2025 were not sanctioned. During the relevant period, the petitioner was in service in the District Adi Dravidar Welfare Department and Pramakudi Revenue Divisional Office. The particulars were sought for from the relevant Departments and the same are yet to be received. Therefore, there is some delay in disbursing the salary due to the petitioner for the abovesaid period.
¶4This Court considered the rival submissions made.
¶5The petitioner, a Junior Revenue Inspector, is eligible for medical leave as per the available provisions. The petitioner claimed that he has taken medical leave for two days in the year 2024, 35 days in the month of April 2025 and 21 days in the month of June 2025 and that too for medical treatment to his mother for the injuries suffered by her. The 3rd respondent shall obtain the relevant particulars from the concerned Departments, where the petitioner rendered his services, within a period of two weeks from the date of receipt of a copy of this order and shall ensure that the eligible salary due to the petitioner is disbursed within a further period of six weeks from thereon.
¶6Accordingly, this writ petition is disposed of. No costs.
