Judgment

O R D E R

This petition has been filed seeking a direction to Respondent Nos. 1 and 2 to conduct proper enquiry and dispose the petitioner's complaint, and representation dated 05.06.2026.

¶2Heard both sides.

¶3The learned Counsel appearing for the petitioner would submit that the petitioner made a representation dated

05.06.2026 to the second respondent, requesting the issuance of a non-traceable certificate in respect of the missing sale deed. However, the second respondent failed to act upon the said representation.

¶4He further submitted that the second respondent sent a letter to the petitioner, without mentioning any date or fixing a date of hearing, directing the petitioner to produce a copy of the Family Card, Voter ID, Aadhaar Card, Driving Licence, Bank Card, etc., as proof of identity, for the purpose of enquiring into the petitioner's request for issuance of a non-traceable certificate. Even after the petitioner complied with the said requirements of the respondent police, the petitioner's grievance was not considered. Therefore, the petitioner has approached this Court seeking the relief prayed for in the present writ petition.

¶5The learned Government Advocate (Crl. Side), appearing for the respondents, would submit that, though the petitioner submitted a representation dated 05.06.2026, requesting the issuance of a non-traceable certificate in respect of the missing sale deed, as per the circular was issued by the Director General of Police, Chennai, dated 01.04.2022, prescribing certain procedures to be followed for the issuance of such a certificate. Pursuant to the said circular, the respondent police sent a letter to the petitioner calling upon him to produce certain documents. However, so far, the petitioner has not produced the documents sought for in the said letter. Therefore, the request of the petitioner is still pending consideration before the second respondent.

¶6Mr.C.Susikumar, learned Government Advocate, submitted that, though the letter sent to the petitioner by the Inspector of Police, Vellanoor Police Station, reflects the manner in which the enquiry has been conducted, but the said letter does not even contain the date of issuance or the date of hearing and merely calls upon the petitioner to produce certain documents.

¶7In view of the above, the petitioner is directed to produce the required documents in accordance with the circular issued by the Head of Police. Upon receipt of the required documents, the respondent police are directed to consider the petitioner's complaint and issue a non-traceable certificate at the earliest, preferably within a period of two weeks from the date of receipt of the said documents from the petitioner.

¶8With the above said observations, this Writ petition is disposed of.
