ORDER This Writ Petition is filed seeking to call for the records of the 1st respondents impugned order in Na.Ka.A3/03/2026 dated 31.07.2026 and quash the same as devoid of merits in respect of findings No.(1) the version of as per the village customs and directing him to ensure the Sri Balaganapathy and Sri Veeramagaliyamman temple located at Thattamanaipatti Village, Keerathur Post, Karambakudi Taluk, Pudukottai District's temple festival of deity charior procession in the Konar and Naidu Communities Street of Naidu Keelatheru (where twenty families are residing) going to be held on 10.08.2026 in view of the order of this Court in WP.Crl.(MD)No.3668 of 2026 dated 06.07.2026 by considering the petitioner's representation dated 03.08.2026, within the period as stipulated by this Court.

¶2The Learned Counsel for the petitioner submitted that pursuant to the order passed by this Court in WP.Crl.(MD)No.3668 of 2026 dated

06.07.2026. The Revenue Division Officer had conducted a peace committee by putting the petitioner as well as arrival parties on notice for the proper conduct of the temple festival as well as the temple car festival of Sri Balaganapathy and Sri Veeramagaliyamman temple located at Thattamanaipatti Village, Keerathur Post, Karambakudi Taluk, Pudukottai District. He pointed out that having conducted a peace committee meeting, the first respondent had mindlessly passed an order excluding the streets of Naidu community and Konaar community and directing the temple authorities to exclude the street of Naidu community during the procession of the temple chariot.

¶3The learned Government Advocate appearing for respondents 1 and 2 submitted that the entire narrative of the petitioner is absolutely false and motivated. Pursuant to the order passed by this Court, a peace committee was properly convened by the first respondent, where it came out clear that from time to time, the Temple Car festival was conducted by taking the temple car only along the main streets. More particularly, the allegation of the petitioner, trying to give a caste conflict colour to the issue by finding out that Naidu Community Street was excluded, is absolutely false for the sole reason that the Main Street through which the temple car proceeds itself, is an area where Naidu and Konar community together live. As many as 50 Naidu community people are living in the locality where the temple car is proceeding. The requirement of the petitioner is that the the temple car should proceed in a particular street where it is not possible for feasibly taking the temple car because of lack of convenience.

¶4The learned Government Advocate appearing for third respondent submitted that there are four houses situated in the particular street, among which 3 belong to Naidu community and one belong to Konar Community. However, the Konnar community people do not have any objection for the temple car to proceed through the main road.

¶5Heard either sides and carefully peursed the materials available on record.

¶6The Temple festival is almost concluded and the final program is the Temple car procession, which is likely to be conducted after midnight today(10.08.2026). In view of the submissions made by the Learned Government advocates, it is clear that neither the revenue authorities nor the police authorities have denied permission for the proper conduct of temple car procession.

¶7The temple car procession route is normally conceded by the Temple administrative Committee, only through the main roads considering the practical difficulties of taking the procession forward. Narrow routes would cause congestion and difficulty for the common public and only in terms of the routes, which was followed by the administrative committee for several years. As far as the street which is sought for by the counsel for the petitioner for the temple Corps procession is very narrow, as pointed out by the learned Government Advocate that it will not be feasible for the temple car to easily enter into a narrow street along with the procession and return back and the same would cause difficulty. That apart, another future possibility of every devotees living in narrow streets, raking up the same claim in future would also cause more difficulty in proper conduct of the temple car processor in future.

¶8I find the said submission to be well-founded and find no infirmity in the impugned order. All the parties are directed to cooperate with the temple festival authorities to peacefully conduct the temple car festival. The devotees are at liberty to worship the principal deity proceeding in the temple car in the main Road.

¶9With the above observation, this Writ Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
