Judgment
ORDER The petitioner has secured a slip for lunch motion and has challenged the impugned auction notice dated 24/07/2026 seeking to auction the rights for collecting Goat kin and for bursting crackers during the temple festival.
¶2The petitioner appears to be an aggrieved party against the appointment of the Management of the temple and has filed A.P.No.7 of 2026 before the 1st respondent / Commissioner of HR & CE under Section 69 of The Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959. It is the case of the petitioner that even the earlier attempt was also made by the private respondents herein to give away the rights and therefore, the petitioner had approached this Court in WP(MD)No.14307 of 2026 which came to be ordered on 20/05/2026 recording the submission that fresh notice will be issued in accordance with the provisions. Prima Page No.2 of 5 facie indications are that a paper publication has been effected in Tamil Edition of Dina Boomi on 23/07/2026 proposing to hold the auction. The scanned reproduction of the said Advertisement dated 24.07.2026 is below:
¶3Merely because the petitioner is challenging the appointment made earlier in A.P.No.7 of 2026, that ipso facto would not give any right to the petitioner to interfere with the management and affairs of the Temple, namely, Arulmigu Muniyappa Swamy Temple, Ellappatti, Page No.3 of 5 Oddanchatram Taluk, Dindigul District. Therefore, the writ petition is liable to be dismissed and accordingly dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
