Judgment
ORDER The writ petition is filed seeking a direction to the respondents to consider the petitioner's representations dated 31.12.2025,
19.06.2026 and 03.07.2026 and to direct the 1st respondent to appoint a Special Tahsildar to reclassify the petitioner's land as "Ryotwari Manai" in terms of G.O.(Ms) No.221, Revenue and Disaster Management Department, Land Records, Survey and Settlement Wing, dated 04.05.2023, and consequently, to issue an individual patta with a new FMB and sub-division in the petitioner's name alone, after deleting the name of the 7th respondent.
2.Heard the arguments of Mr.K.Prabakaran, learned counsel for the petitioner, and Mr.C.Deepak, learned Additional Government Pleader for the respondents. Since no adverse order is going to be passed against the 7th respondent, notice to him is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, he claims right over the subject property under the Partition Deed bearing Document No.1632 of 1998 and the Exchange Deed bearing Document No.1964 of 2006. According to him, originally, the subject property was a private land and the same was wrongly classified as Government poramboke land during the UDR correction. Therefore, he submitted a representation before the 2nd respondent on 03.07.2026, seeking rectification of the error in the revenue records. Since the same has not been considered, he has approached this Court.
4.The learned Additional Government Pleader, who takes notice for the respondents, would submit that the representation of the petitioner was received only on 20.07.2026 and that the same will be considered in accordance with law within the time fixed by this Court.
5.In view of the above submission, this Court is inclined to pass the following order: "Since the request for UDR correction can be considered only by the 1st respondent, the 2nd respondent is directed to forward the petitioner's representation dated
03.07.2026 to the 1st respondent, along with his report, within a period of six weeks from the date of receipt of a copy of this order. Thereafter, the 1st respondent shall consider the same and pass final orders on its own merits within a further period of twelve weeks, after issuing notice to the petitioner, the 7th respondent and other interested parties."
6.With the above directions, this writ petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
