This Petition is filed seeking to direct the respondents 1 to 3 to provide adequate police protection to the petitioner.
¶2The memo filed in the case reveals that the petitioner is the Secretary of the Trust, which has commenced construction of a temple in the temple land. The private respondents 4 to 9, who are the neighbouring landowners, are alleged to have obstructed the construction of the Mandapam in the temple premises. Aggrieved by the said obstruction, the petitioner submitted representations/ complaints to the Superintendent of Police, Thoothukudi District, the Deputy Superintendent of Police, Thoothukudi District, and the Inspector of Police, Ettayapuram Police Station, Thoothukudi District. Since no effective action was taken on the said representation/complaint, the present writ petition has been filed.
¶3The learned Government Advocate (Criminal Side) submitted that, though the petitioner had lodged a complaint before the Inspector of Police, the same was forwarded to the Superintendent of Police and thereafter received by the Inspector of Police for enquiry . During the course of enquiry, the petitioner gave a statement stating that he did not intend to pursue the matter any further, as the villagers were not causing any obstruction to the construction of the Mandapam. Based on the said statement given by the petitioner, the police closed the complaint, and the closure proceedings have also been produced before this Court.
¶4The records placed before this Court by the State, coupled with the submissions made by the learned Government Advocate (Criminal side), reveal that, on 04.08.2026, the Inspector of Police closed the complaint on the basis of the written statement given by the petitioner.
¶5The learned counsel for the petitioner submitted that, though the Inspector of Police had closed the present complaint, which was forwarded by the Superintendent of Police, the complaint originally given by the petitioner before the Inspector of Police is still pending. He further submitted that the police had assured the petitioner that necessary police protection would be provided during the Kumbabishekam. The said submission was disputed by the learned Government Advocate (Criminal Side).
¶6The learned counsel for the petitioner sought a copy of the closure proceedings. Accordingly, the learned Government Advocate (Criminal Side) was directed to furnish a copy of the closure proceedings forthwith.
¶7On perusal of the closure proceedings, it is seen that neither the proceedings nor the decision taken thereon was communicated to the parties concerned at the earliest point of time. In the event of any further cause or dispute arising in future, it is always open to the petitioner to approach the police in accordance with law.
¶8Since the complaint has already been closed on the basis of the statement given by the petitioner himself, the apprehension of the petitioner that the police would proceed further with the very same complaint does not arise.
¶9Recording the same, this Writ Petition is closed.
