Court
High Court of Madras
Decided

Bench

Case no.
WP(MD) 23642/2026

Judgment

ORDER The writ petition is filed seeking a direction to the respondents 2 and 3 to consider the petitioner's objections dated 08.08.2026 and

10.08.2026 prior to conducting any survey in respect of the property situated at Survey No.347/4B, Sriramasamuthiram Village, Thottiyam Taluk, Tiruchirappalli District.

2.It is seen from the typed set of papers that the 4th respondent had earlier filed a writ petition in W.P(MD) No.2643 of 2025 before this Court seeking adequate police protection for surveying his property comprised in Survey No.347/4B, situated in the said village. The said writ petition was disposed of with the following direction: "4.........Therefore,

this

Court,

without expressing any opinion on the merits, directs the first respondent to issue notice to the petitioner as well as the fourth respondent and conduct survey in the petition mentioned property in the presence of the petitioner and the fourth respondent. The third respondent shall provide adequate police protection for the said survey. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order."

3.It appears that, pursuant to the direction issued in the said writ petition, the respondents issued notice to the petitioner for the purpose of surveying the property. The petitioner is said to have submitted objections dated 08.08.2026 and 10.08.2026. Thereafter, the instant writ petition has been filed by the petitioner seeking a direction to the respondents to consider the said objections.

4.In the earlier order passed by this Court in W.P(MD)No.2643 of 2025, this Court had issued a positive direction to the respondents to conduct a survey of the property in the presence of the petitioner and the 4th respondent and there was no direction therein to consider the objections of the parties and take a decision with regard to the survey of the property. In such circumstances, if the petitioner is aggrieved by the said order, it is for him to challenge the same in the manner known to law, either by filing a writ appeal or by seeking appropriate clarification. Therefore, I am not inclined to entertain this writ petition.

5.Accordingly, the same is dismissed with liberty to the petitioner to workout his remedy in the manner known to law. No costs. Consequently, the connected miscellaneous petition is closed.
