Judgment

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 12/10/2023 PRESENT The Hon`ble Mr.Justice G.ILANGOVAN George Durai ... Petitioner / Accused No.4 Vs The State rep by The Inspector of Police, Sayalkudi Police Station, Ramanathapuram District. (Crime No.149 of 2023). ... Respondent / Complainant

For Petitioner : M/s.Ramamoorthi B, Advocate.

For Respondent : Mr.S.Ravi,

Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.149 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 8(c) r/w 20(b)(ii)(A) of NDPS Act, in Crime No. 149 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 08.07.2023 at 12.40 hours, at Rojma Nagar the 1st accused was found in possession of 50 grams of ganja. Based on the confession of A1 & A3 other accused persons were implicated. Hence, the case.

3.On the ground that only on the basis of the confessional statement of the third accused this petitioner is implicated in this case. The learned counsel for the petitioner would submit that except this case, no similar case is pending.

4.The learned Additional Public Prosecutor would submit that five previous cases are pending against the petitioner. Among which, one is under Section 302 of IPC and another one is for the offence of robbery.

5.Considering the bad antecedents of the petitioner, the earlier anticipatory application filed by the petitioner was dismissed by this Court. Now I find absolutely, no change of circumstances to entertain this petition.

6.Accordingly, this criminal original petition stands dismissed.
