Judgment
O R D E R (Order of the Court was made by M.DHANDAPANI, J.) This Writ Petition has been filed for issuance of a Writ of Mandamus directing the second respondent to remove the encroached compound wall on the Nilaviyal paathai in the land in S.No. 183/5A situated in Sallichettipatti Village, Villathikulam Taluk, Thoothukudi District.
¶2Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.
¶3Since no adverse order is going to be passed, notice to the fifth and sixth respondents is dispensed with.
4.The petitioner claims that the land in question is classified as Government land in the revenue records and that a Nilaviyal Paathai exists in S.No.5A. The grievance of the petitioner is that the administrators of Veeraalagammal Kovil have illegally constructed a compound wall around the entire extent of land comprised in S.No.183/4, thereby obstructing the devotees of Sri Kasi Thatha Jeeva Samathi from accessing the Samathi through the said Nilaviyal Paathai. In this regard, the petitioner has submitted a representation dated 07.08.2026 before the respondents, seeking appropriate action against the administrators of the said Kovil. Since no effective action has been taken on the said representation, the present Writ Petition has been filed.
¶5The learned counsel appearing for the petitioner would submit that it would suffice if this Court issues a direction to the second respondent to consider the petitioner's representation dated 07.08.2026 and pass appropriate orders thereon, on merits and in accordance with law, within a time frame to be fixed by this Court.
¶6The learned Special Government Pleader appearing for the official respondents, on instructions, would submit that the authority concerned will consider the petitioner's grievance and pass appropriate orders on merits and in accordance with law.
¶7Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 07.08.2026 and pass appropriate orders on merits and in accordance with law, after issuing notice to all necessary parties including the respondents 5 and 6 and affording them an opportunity of hearing. The entire exercise shall be completed as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order. No costs. [M.D.I.,J.] & [N.D.K.,J.]
