Judgment

O R D E R (Order of the Court was made by M.DHANDAPANI, J.) This Writ Petition has been filed for issuance of a Writ of Mandamus directing the respondents 1 to 4 to remove the encroachment made by respondents 5 and 6 in the lands comprised in Survey Nos.320/3A1, 320/3A2, 320/3B, 320/6A1, 320/6A2, 320/6B1 and 320/6B2, situated at Kayaodai Village, Kalaiyarkoil Taluk, Sivagangai District, which have been classified as Unoccupied Government Poramboke Land pursuant to the proceedings of the District Revenue Officer, Sivagangai District, in Na.Ka. C3/14830/2024 dated

16.09.2025, and to restore the said lands to the Government, in accordance with law.

¶2Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.

¶3Since no adverse order is going to be passed, notice to the respondents 5 and 6 is dispensed with.

4.The petitioner asserts that the land in question was wrongly entered in the names of the private respondents. However, pursuant to the representation submitted by him seeking correction of the revenue records, the erroneous patta entries were cancelled and the said land has already been classified as Unoccupied Government Poramboke Land vide the proceedings of the District Revenue Officer, Sivagangai District, in Na.Ka. C3/14830/2024 dated

16.09.2025. The petitioner alleges that the respondents 5 and 6 have encroached upon the said land and put up construction thereon. In this regard, the petitioner has submitted a representation dated 06.08.2026 before respondents 1 to 4, seeking initiation of appropriate proceedings for removal of the encroachments. Since no effective action has been taken on the said representation, the present Writ Petition has been filed.

¶5The learned counsel appearing for the petitioner would submit that it would suffice if this Court issues a direction to the respondents 1 to 4 to consider the petitioner's representation dated 06.08.2026 and pass appropriate orders thereon, on merits and in accordance with law, within a time frame to be fixed by this Court.

¶6The learned Additional Government Pleader appearing for the official respondents, on instructions, would submit that the authority concerned will consider the petitioner's grievance and pass appropriate orders on merits and in accordance with law.

¶7Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondents 1 to 4 to consider the petitioner's representation dated 06.08.2026 and pass appropriate orders on merits and in accordance with law, after issuing notice to all necessary parties, including the respondents 5 and 6, and affording them an opportunity of hearing. The entire exercise shall be completed as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order. No costs. [M.D.I.,J.] & [N.D.K.,J.]
