Judgment

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 19.08.2026 PRESENT The Hon`ble Mr.Justice K.MURALI SHANKAR Revathi ... Petitioner/ Accused No.4

Vs The State of Tamil Nadu, represented by The Inspector of Police, Thiruvidaimarudhur Police Station, Thanjavur District. (Crime No.771/2026) ... Respondent/ Complainant For Petitioner : Mr.A.Senthilkumar Advocate. For Respondent : Mr.T.Lenin Kumar Counsel for State of TN (Crl.Side) PETITION FOR BAIL Under Section 483 of B.N.S.S. PRAYER :- For Bail in Crime No.771 of 2026 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A.4, who was arrested and remanded to judicial custody on 03.08.2026 for the offences punishable under Sections 109, 120B, 420, 447, 465, 466, 468, 471 I.P.C., in Crime No.771 of 2026, on the file of the respondent police, seeks bail.

¶2The case of the prosecution is that the properties allegedly originally belonging to one Ambujavalli Ambal Dharmam and transferred the said property in the name of one Ponnusamy Pillai and subsequently, the same was purchaed by the petitioner's husband and on the basis of the above allegations, the respondent police registered the present complaint.

¶3The learned Counsel for the petitioner would submit that the property in dispute was owned by one Ponnusamy and the petitioner's husband purchased the property from the said Ponnusamy and since then, some third parties had attempted to interfere with the possession of the property and hence, the petitioner was constrained to lodge a complaint, but the respondent police, after the registering the F.I.R., arrayed the petitioner and her husband as accused in the above F.I.R.

¶4The learned Counsel for State of TN (Crl.side) would submit that the property was originally owned by Ambujavalli Ambal Dharmam Trust and that neither the said Ponnusamy nor the petitioner's husband has any right over the said property and that the sale deed was taken in the name of the petitioner's husband from the said Ponnusamy and that is why the present F.I.R., came to be registered.

¶5The learned Counsel for the petitioner would further submit that the petitioner has absolutely no connection whatever with the execution of sale deed or any other transaction existed between the petitioner's husband and Ponnusamy and hence, the petitioner may be enlarged on bail.

¶6Considering the above facts and circumstances and also taking note of the fact that the petitioner was neither a party nor a witness to the alleged sale deed and that she is not having any previous case, this Court is inclined to grant bail to the petitioner subject to the following conditions:

7.Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the District Munsif cum Judicial Magistrate, Thiruvidaimarudhur.

(vi)If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS, 2023. (K M S J)
