Judgment

O RDER

This Criminal Original Petition is filed to to call for the entire records connected to the summon, dated 01.10.2023 issued by the repsondent No.1 and quash the same.

¶2The learned counsel for the petititioner would submit that this petitioner and the defacto complainant namely Surya are friends from childhood. At request of Surya to pledge her jewels to meet out her personal expenses, the petitioner pledged the jewels of Surya in her name for a sum of Rs.7,40,000/-. Further, she borrowed a sum of Rs.1,00,000/- from Surya in the month of April, for which also, she paid monthly interest. In these circumstances, one day Surya approached this petitioner, asked to redeem her jewels and demanded Rs.1,00,000/- also. This petitioner asked time to return the money in three installments. But the said Surya refused her request and entered into quarrel with her. Later, she gave a complaint against the petitioner, foisting false allegations. The respondent Police did not issue proper summons and they called for enquiry over phone call. This petitioner also appeared before the respondent Police. At that time, they threatened to return Rs.8,00,000/-. Hence, this petition has been filed to quash the summon issued by the first respondent.

¶2Since it is a money issue, let the petitioner appear before the first respondent Police and co-operate with him to complete the process of enquiry. I find no reason to entertain this petition.

¶3With the above said direction, this Criminal Original Petition deserves dismissal and accordingly dismissed. Consequently, the connected Miscellaneous Petition is closed.
