Judgment

O RDER

This petition is filed seeking direction to the respondents 1 and 2 to provide necessary Police Protection to the petitioner's life and limb by taking action against the respondents No.3 to 9 by considering the petitioner's representation dated 12.09.2023.

2.Pending suit in O.S.No.295 of 2023 on the file of the Sub Court, Ramanathapuram, for declaration and injunction, the representation was made by the petitioner seeking police protection since trouble was made by the private respondents herein.

3.The learned Additional Public Prosecutor (Crl. Side) would submit that based on the complaint given by the petitioner, enquiry is undertaken in C.No.G3/22308/2214/2023. During the course of enquiry, both sides appeared and the private respondents gave an undertaking that he will not make any trouble to the petitioner. Apart from that, they were also advised to approach District Crime Branch, Ramanathapuram, for appropriate enquiry. Further action was dropped by the second respondent.

4.Since the suit is pending between the parties, granting police protection either one of the parties may not be proper. The petitioner is at liberty to work out their remedy in the pending suit. I absolutely find no reason to entertain this petition.

5.Accordingly, this criminal original petition is disposed of with the above said liberty. Speaking : Yes / No
