Judgment

ORDER The present contempt petition has been filed alleging violation of the order of this Court, dated 19.07.2021 made in W.P(MD)No.12161 of 2021. This Court by the order referred to supra had directed the respondent Transport Corporation to refer the petitioner to Medical Board and after ascertaining his fitness, allot him an alternative employment on the basis of Section 20(4) of the Rights of the Persons with Disabilities Act, 2016.

¶2According to the learned Standing Counsel appearing for the respondents, the petitioner was accommodated in an alternative employment of Technician even in the year 2021 and he is working from the said year onwards. Therefore, there is no violation of the order of this Court. However, the learned Counsel appearing for the contempt petitioner contends that they should have accommodated him as a Time Keeper and accommodating him as a Technician would not satisfy the order of this Court.

¶3A perusal of the order of this Court clearly reveals that there is no positive direction by this Court to appoint the petitioner as a Time Keeper. Therefore, the respondent Corporation has allotted an alternative employment with pay protection. Incase, if the petitioner is not satisfied with the alternative employment, it is for him to approach the respondent Corporation again seeking any further alternative employment. There is no violation of the order of this Court. Hence, this contempt petition stands closed.
