Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 687 of 2023 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 379 I.P.C and 21

(1) of Mines and Minerals (Development and Regulations) Act, in Crime No.687 of 2023 on the file of the respondent Police, seeks anticipatory bail.

¶2The case of the prosecution is that the petitioner has found in illegal transportation of ¼ unit river sand through his vehicle without any valid permission and license and the same was seized by the respondent Police. Hence, the complaint.

¶3The learned counsel for the petitioner submitted that the petitioner is an innocent and is no way connected in this case.

¶4The learned Government Advocate (Crl. Side) would submit that the petitioner is having one previous case of similar nature. The earlier anticipatory bail applications were dismissed by this Court considering the bad antecedents of the petitioner.

¶5Considering the fact that there is no change of circumstances and one previous case is pending against the petitioner, which is in similar nature, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this anticipatory bail petition deserves dismissal and accordingly dismissed. sd/- 16/11/2023 / TRUE COPY / /12/2023 Sub-Assistant Registrar (C.S.)
