Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. not known of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 406 and 420 I.P.C., in Crime No. Not known of 2023 on the file of the respondent police, seeks anticipatory bail.
¶2The case of the prosecution is that on believing the words of the petitioner the defacto complainant has given a sum of 72,05,000/- to the petitioner for the purchase of machinery to use for stone quarry, but, he has not sent the machine to him. Hence, the complaint.
¶3Today, when the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondent would submit that during the course of enquiry, both the parties have compromised the matter and the petitioner has also agreed to pay the amount on or before 10.01.2024 and for which, the defacto complainant has also no objection and hence, the said complaint was closed.
¶4Now, the grievance of the petitioner is that he has also given a complaint on
07.11.2023 stating that the defacto complainant forcibly entered into a compromise and took away the iron scraps worth about Rupees Two Crores from the petitioner's place, but, so far no action taken by the respondent police.
