Judgment

ORDER This petition has been filed seeking direction to the respondents 1 and 2 to give adequate police protection for the life and limb of the petitioner, based on the representation dated 20.10.2023.

2.Pending suit in O.S.No.26 of 2023 on the file of the Additional Sub Court, Madurai, for declaration and injunction, the representation was made by the petitioner seeking police protection since trouble was made by the private respondents herein.

3.The learned Additional Public Prosecutor (Crl. Side) would submit that based on the complaint given by the petitioner, enquiry is undertaken. During the course of enquiry, both sides appeared and the private respondents gave an undertaking that he will not make any trouble to the petitioner. Apart from that, they were also advised to work out their remedy through appropriate civil process.

4.Since the suit is pending between the parties, granting police protection either one of the parties may not be proper. The petitioner is at liberty to work out their remedy in the pending suit. I absolutely find no reason to entertain this petition.

5.Accordingly, this criminal original petition is dismissed with the above said liberty.
