Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C. PRAYER :- To enlarge the petitioner on bail in SC No.214/2022 on the file of Sessions Judge, Fast Track Mahila Court, Virudhunagar District at Srivilliputtur in Crime No.123/2022 on the file of the respondent police and thus render justice. ORDER : The Court made the following order :- The petitioners/A4 and A5, who were arrested and remanded to judicial custody on 23.08.2022 for the offence punishable under Sections 341,366,397,506(ii) ,354(B), 376(D) and Section 66 E and 79 of I.T.Act in crime No.123 of 2022 on the file of the respondent police, seek bail.

2.The case of the prosecution is that the petitioners herein along with other accused had committed gang rape on the defacto complainant and also had taken jewels, cellphone and cash of Rs.1800/- from the defacto complainant , hence the case.

¶3This is the second application for bail and the earlier application for bail was dismissed by this Court on 14.06.2023 and there is no change in circumstances of the case to consider the present bail application for bail.

¶4Hence the petition stands dismissed.
