¶2The case of the prosecution is that the petitioner theft a sum of Rs.18 lakhs from the defacto complainant. Hence, the case.
3.The learned Counsel appearing for the petitioner would contend that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that this Court vide order dated
24.11.2023 has granted interim bail to the petitioner on condition that the petitioner shall surrender before the jail authority today. As ordered, the petitioner has surrendered. Hence, he prays for bail to the petitioner.
¶4The learned Additional Public Prosecutor appearing for the respondent Police would submit that the petitioner theft a sum of Rs.18 lakhs from the defacto complainant and no recovery has been made. Hence, he strongly opposed to grant bail to the petitioner.
5.Heard both sides and perused the materials available on record.
¶6It is seen that this Court vide order dated 24.11.2023 has granted interim bail to the petitioner on condition that the petitioner has to surrender before the jail authorities on 05.12.2023 and he has also surrendered today. Therefore, considering the facts and circumstances and also considering the period of incarceration and taking into consideration of the principle stated by the Honourable Supreme Court in Sanjay Chandra and others vs. CBI reported in (2012)1 SCC 40, this Court is inclined to grant bail to the petitioner, subject to the following conditions:
(i) Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Tenkasi on further conditions that:
