Judgment

O R D E R

This Criminal Original Petition has been filed to direct the second respondent to provide adequate police protection to the life and limb of the petitioner and his family members.

¶2In respect of issue between the parties in S.A(MD) Now.238 of 2023 to 240 of 2023 is pending before this Court. According the petitioner, pending second appeal, the private respondent trespassed into the property and caused damage by closing the pathway, for which complaint was also given by the petitioner seeking police protection and for taking action.

¶3Pending second appeal, the third respondent entered into the property and caused damage. Hence, the petitioner sought police protection before the second respondent. It is admitted that second appeal is pending before this Court and trouble is made by the third respondent. Pending second appeal the petitioner can only approach the second appellate Court for appropriate order. Seeking police protection pending second appeal will not lie. On that ground the petitioner is not maintainable.

¶4In view of the same, the Criminal Original Petition stands disposed of with liberty to the petitioner to approach the second appellate Court.
