Judgment
ORDER This writ petition is filed seeking direction to the respondents to permit the petitioner to fully withdraw his money of the payment of his retirement benefits amount Rs. 5,12,810/- from his account vide S.B.A/c.No. 71591010012640 being maintained with the 4th respondent at a time instead of installment withdrawals with an accrued interest.
¶2Considering the fact that the petitioner's terminal benefits have also been deposited into his account, there can be no impediment to the withdrawal of the said amount lying to his credit.
¶3The learned Government Advocate would submit that the audit of the 3rd respondent Society is still pending, and that only after the audit is completed and any objections are received can the matter be finalized; otherwise, it would be difficult to recover the amount from the petitioner. Hence, she submitted that no such mandamus be granted.
¶4This Court is of the view that if any objection is raised in the audit with regard to the petitioner's amount, it is for the respondents to recover the same in the manner known to law, as provided under the Tamil Nadu Co-operative Societies Act, 1983. Having sanctioned the terminal benefits and credited them to the petitioner's account, the respondents cannot deny the petitioner to withdraw the amount already standing in his name.
¶5In view of the same, there shall be a direction to the respondents to permit the petitioner to withdraw the amount standing in his Saving Bank Account.
¶6This writ petition is disposed of with the above directions. No costs.
