¶2According to the learned counsel appearing for the petitioner in his private patta land, in a high handed manner, the respondent authorities are attempting to erect a high voltage power grid and tower across his property.

¶3The learned Standing Counsel appearing for the respondents submit that it is a tower line project connecting Malaikovilur Sub Station to Velliyanai Sub Station. Already all the towers had been put up and now drawing up lines are going on.

¶4As far as the case of the writ petitioner is concerned, they are not going to erect any tower in the petitioner's patta land. However, a small space will be taken away from the petitioner's land and for any such damages to the petitioner's land, he would be entitled to seek compensation as per G.O.(Ms)No.86 Energy (A1) Department dated

21.07.2022 W.P(MD)No.9925 of 2025 dated 08.04.2025, wherein two learned Judges of this Court have categorically held that no orders could be passed by the Court restraining officials from putting up towers or posts in the private patta land and the concerned party would only be entitled to receive proper compensation from the competent authority.

¶6In view of the above said case, the writ petition stands disposed of with a direction to the petitioner to approach the competent authority to seek compensation. No costs. Consequently, connected miscellaneous petition is closed.
