Judgment

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 10/02/2026 PRESENT The HONOURABLE MRS. JUSTICE S.SRIMATHY

¶1Vairamuthu

¶2M Venkatesh ... Petitioners/Accused

Vs The State of Tamilnadu Rep.,By, The Inspector of Police, Melur Police Station, Madurai District. (Crime No. 469 of 2025) ... Respondent/Complainant For Petitioners : M/s. William Chirstopher.J

For Respondent : Mr.S.S.Manoj, Government Advocate (Crl.Side) For Intervenor : Mr.V.Malaiyendran PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.469 of 2025 on the file of the respondent police ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 356(1), 336(4), 308(4) and 351(2) of BNS, in Crime No.469 of 2025, seek anticipatory bail.

¶2The case of the prosecution is that the defacto complainant is the General Secretary of the Scheduled Wing of the Madurai East District BJP Party. The petitioners allegedly do not belong to the BJP political party. However, on 13.09.2025, the petitioners are alleged to have extorted money from the local traders of Melur under the guise of collecting donations for distributing free sarees to poor people for Diwali, in the name of "Modi Diwali," by misusing the name of the BJP Party and by fabricating bill receipts in the name of the BJP Party. Hence, the case.

¶3The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners.

¶4The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the petitioners, who do not belong to the BJP, allegedly extorted money from local traders of Melur on

13.09.2025 under the guise of collecting donations for distributing free sarees for "Modi Diwali," by misusing the name of the BJP Party and fabricating bill receipts. Therefore, he opposed for the grant of anticipatory bail to the petitioners.

¶5This is the second anticipatory bail application and this Court has already considered and dismissed the earlier application. The contention of the petitioners is that they are still members of the SC/ST Committee of the BJP Party and they have produced a letter dated

06.08.2025 in support of the same. On perusal of the said letter, it is seen that only a notice was issued. However, the subsequent proceedings of the State Committee dated 08.10.2025 reveal that the petitioners' names are not included as members of the SC/ST Committee. Therefore, this Court is of the considered opinion that the petitioners are not members of the said committee. The allegations stated in the FIR are prima facie correct. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.

¶6Accordingly, this Criminal Original Petition is dismissed. (S S Y J)
