Judgment

ORDER This Writ Petition has been filed challenging the impugned refusal check slip in Refusal RFL No. Alwar Thirunagari/63/2025 dated 27.11.2025 issued by the first respondent and to direct the first respondent to register the sale deed dated 27.11.2025, in Survey Nos.37/1B, 38/1, 38/2, 39/1, 39/2, 41/1, 41/2, 42/1, 42/2, 42/3, 43/1, 43/2, 44/1, 44/2, 44/3, 44/4, 48/1A1A, 48/1A1, 48/1A1B (Patta Nos.1515 and 2036) of Thenthiruperai Kaspa Village, Alwar Thirunagari, Thoothukudi District, immediately on presentation.

¶2The learned counsel appearing for the petitioner would submit that the impugned refusal check slip was issued for the reason that sufficient stamp duty was not paid. He would submit that the subject document is only a settlement among family members and that the petitioner is ready and willing to pay the necessary stamp duty.

¶3The learned Special Government Pleader appearing for the respondents would submit that on payment of appropriate stamp duty as per the value of the property, the petitioner's document will be considered for registration.

¶4Heard both sides.

¶5According to the petitioner, the subject document is only a settlement among the family members. If such is the case, the petitioner would be liable to pay the appropriate stamp duty for settlement among family members alone. Anyhow, this Court directs the petitioner to re-present the settlement deed dated 27.11.2025 before the first respondent and to pay appropriate stamp duty for settlement among family members, in accordance with the Indian Stamp Act, until and otherwise, an outsider is settling the property. On such re-presentation and payment of appropriate stamp duty, the first respondent is directed to register the settlement deed dated 27.11.2025, forthwith, if it is otherwise in order.

¶6Accordingly, this Writ Petition is disposed of. No costs.
