¶2Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.
¶3The learned counsel for the petitioner submits that the lands in S.Nos.1316/3A, 1316/6, 1315/2, 1315/4 and 1314/5, Mallapuram Village, Guziliamparai Taluk, Dindigul District, were purchased by the petitioner vide sale deed dated 12.10.2001. Out of the total extent of 7 acres and 60 cents, the petitioner sold 5 acres and 58 cents to one Selvaraj and the remaining 2 acres and 2 cents was with the petitioner. While so, the respondents are attempting to lay a road in the patta land of the petitioner without following due process and without any acquisition whatsoever in the manner known to law.
¶4However, the learned Additional Government Pleader appearing for the respondents would submit that before laying any road, survey would be conducted on giving notice to the petitioner and others, if any.
¶5It is to be noted that it is the stand of the respondents that before laying any road, survey would be conducted and necessary notice would be issued to the parties concerned. The petitioner has also agreed for the same.
¶6In view of the above, the writ petition stands closed. No costs. Consequently connected Miscellaneous Petition is closed.
