[2] The simple case of the petitioner is that his date of birth as recorded in the matriculation certificate and the other service records is 01-03-1963. However, due to inadvertent mistake on the part of some officials of the Government, his date of birth is wrongly entered in some of the official documents relating to the petitioner as 01-03-1966 instead of correct date of birth, i.e. 01-03-1963. Having aggrieved, the petitioner already approached the concerned authorities of the Government by submitting several representations, however, without any result. Having no alternative, the petitioner approached this Court by filing the present writ petition for issuing a direction to the respondents to take necessary steps for correction of his date of birth in all the official records pertaining to the petitioner. [3] Mr. Anjan Prasad Sahu, learned counsel appearing for the petitioner submitted that in the counter affidavit filed by the respondents, the respondents have categorically stated that the authorities after having knowledge about the correct date of birth of the petitioner, have taken up NINGOM BAM VICTORIA by NINGOMBAM VICTORIA Date: 2023.08.22 15:18:09 +05'30'
necessary process for making necessary correction of the date of birth of the petitioner in all the relevant official records. Accordingly, taking into consideration the steps taken by the respondents, the learned counsel appearing for the petitioner submitted that the present writ petition can be disposed of by directing the respondents to make necessary correction of the date of birth of the petitioner in all the relevant official records within a stipulated period. [4] Mr. Y. Ashang, learned Government Advocate appearing for the respondents fairly submitted that having knowledge about the correct date of birth of the petitioner and the inadvertent mistake committed by the officials, the concerned authorities of the State Government are taking up process for making necessary correction of the date of birth of the petitioner in all the relevant official records and that if this Court grants some time to the authorities, necessary correction can be carried out. [5] I have heard the rival contentions made by the learned counsel appearing for the parties and also examined the material available on record. Taking into consideration the simple nature of the case, this Court is of the considered view that the present writ petition can be disposed of with the following direction:–
The respondent Nos. 1, 2 & 3 are hereby directed to make necessary correction of the date of birth of the petitioner in all the relevant official records by recording the date of birth of the petitioner as 01-03-1963 instead of 01-03-1966.
