Judgment
O R D E R 03-12-2024
Heard Mr. Th. Jugindro, learned counsel appearing for the petitioner and Mr. Niranjan Sanasam, learned GA appearing for the respondents.
In view of the limited prayer and as agreed to by both the counsel appearing for the parties, the present writ petition is being disposed of at the Motion stage itself.
At the outset, the learned counsel appearing for the petitioner submitted that to redress his grievance, the petitioner has already submitted a representation dated 12-06-2024 to the Secretary, Works -cum-Estate Officer, Government of Manipur, with a request for allowing to allocate a Government Quarter: Type-II/C-25 situated at Lamphelpat in his favour and that the said representation is still pending for consideration. In the meantime, a report dated 14-11-2024 has been submitted by the Sub-Deputy Collector, Imphal West (Central) – I to the Sub-Divisional Officer, Lamphel, Imphal West by stating that the petitioner is presently occupying the said quarter without authorization. The learned counsel submitted that the present petitioner will be satisfied if the present writ petition is disposed of by directing the Secretary, Works-cum-Estate Officer to consider the said representation on its own merit and to dispose of the same by issuing appropriate order within a stipulated time. The learned counsel further submitted that pending consideration and disposal of the said Supp. IN. 5 SHOUGRAKPAM DEVANANDA SINGH Date: 2024.12.03 15:08:59 +05'30' WP(C) No. 831 of 2024 Contd…/-
representation, the respondents may be directed not to evict the petitioner from the said quarter.
Mr. Niranjan Sanasam, learned GA appearing for the respondents fairly submitted that as the prayer of the petitioner is confined to the consideration and disposal of the representation submitted by him, he has no objection in disposing of the present writ petition as prayed for on behalf of the petitioner. The learned GA, however, submitted that a condition or a rider may be added that pending consideration and disposal of the representation submitted by the petitioner, he may not be evicted, if not already evicted from the said quarter.
In view of the submission made by the counsel appearing for the parties, this court is of the considered view that the present writ petition can be disposed of with the following directions for the ends of justice:-
(i) The Secretary, Works-cum-Estate Officer, Government of Manipur, is hereby directed to consider the representation dated 12-06-2024 submitted by the petitioner for allotting a Government Quarter: Type-II/C-25 situated at Lamphelpat in his favour and to dispose of the same by issuing appropriate and speaking order within a period of one month from the date of receipt of a certified copy of this order; and
(ii) It is made clear that pending consideration and disposal of the said representation, the respondents are directed not to evict the present petitioner from occupation of the said quarter, if not already evicted.
With the aforesaid directions, the present writ petition is disposed of.
