21.  The petitioner herein contends that he is fully eligible to be considered for appointment to the post of Veterinary Officer in Sports Persons Punjab (General) Category and the respondent No. 2/PPSC by misinterpreting the provisions of the 1988 Rules, besides the 2020 Rules rather has illegally declared the petitioner to be ineligible to be considered for recruitment to the posts (supra) in the Sports Persons Punjab (General) Category. Common Submissions of the learned counsels for the petitioner(s).

22.  a)  The learned counsel for the petitioner(s) submit, that the incorporation of word 'Senior' in Rule 2(d)(a)(ii) of the 1988 Rules, thus by way of the impugned notification dated 20.07.2020, rather is not   based   upon   any   intelligible   differentia,  therebys   an   arbitrary distinction based on the ages of the aspirants concerned, but becomes drawn. It is further argued that since the sporting talents are to be nursed at the nascent stage and are also got to be suitably rewarded. Contrarily, the incorporation of the word "Senior", does undermine the sporting talents possessed by those who may not have participated in Senior National Championship(s). In sequel, it is argued that the said defeats the very objective of the Rules and discriminates between Senior and Junor Players. b) The said amendment is only for Class I and Class II posts,   whereas,   there   is   no   change   or   amendment   in   the   Rules governing the Class – III and Class – IV posts.  Moreover, if we go by the impugned amendment dated 20.07.2020, then the players having played Senior National Championship will be eligible for reservation for Class – I and Class – II posts and the players having played State and District Championship, shall be respectively eligible for class – III and Class – IV posts. Hence, the amendment (supra) is violative of Articles 14 and 16 of the Constitution of India. c)  Moreover, there is no classification of senior or junior championship, as regards the sporting discipline of cricket. Inferences of this Court.

23.  The impugned amended Rule 2(d)(a)(ii), though bestows an apposite entitlement to the aspirant, but yet requires qua the aspirant concerned bagging gold, silver or bronze medal in Senior National Championship or National Games thus in team or in individual events. Moreover, the baggings (supra) by the aspirant concerned, is enjoined by the Rules (supra), to be while his/her representing the State of Punjab.   In  addition,   the   sporting   event(s),   whereins,   the   aspirant participates   becomes   enjoined   by   the   Rules   (supra),   to   become conducted by such National Sports Federations, as are affiliated or recognized to the Indian Olympic Association.

24.  As an  alternative to  the said  eligibility criteria, Rule 2(d)(a)(iii) stipulates that the aspirant is required to be winning first, second or third position in team or in individual events and/or is required to be wining gold, silver or bronze medal, but at International Sports Meets, which are conducted by the Sports Federation affiliated or recognized by the International Olympic Committee or by the International Olympic Committee itself.

25.  In-so-far as the aforesaid eligibility criteria at paragraph No. 24 is concerned, the same contemplates the baggings of gold, silver or bronze medals in individual or team events, but yet at International Sports Meets, which become conducted by the Sports Federation affiliated or recognized by the International Olympic Committee or by the   International   Olympic   Committee   itself.   Resultantly   the   said alternative   eligibility   criteria   (supra)   requires   the   exemplary performances   by   the   sports   persons   or   aspirants   concerned,   atKAVNEET SINGH International Sports Meet(s). In sequel, the benchmark as contemplated in  the  Rules   (supra),  is   naturally  higher  than  the  benchmark   as contemplated in the prior thereto eligibility criteria i.e. at paragraph No.

¶23  However,   though   the   criteria   (supra),   does   not   create   any discrimination   based   on   the   age   of   the   participant   concerned. Resultantly for the aspirant becoming bestowed the benefit of the criteria (supra), he is only required to irrespective of his/her age, thus bag the first, second or third position in team or individual events or is required to be wining gold, silver or bronze medals in the manner as detailed (supra).

¶26Nonetheless,   the   (supra)   becomes   enjoined   to   be   at International Sports Meets, which further become enjoined to become conducted by the Sports Federation affiliated or recognized by the International Olympic Committee or by the International Olympic Committee itself. Therefore, when in the International Sports Meets concerned,   which   are   conducted   by   the   Sports   Federation   rather affiliated or recognized by the International Olympic Committee, thus would make the participants thereins, to secure the baggings (supra), wherebys he/she rather would become eligible in the sports quota reservation. Contrarily when certain sporting disciplines or events organized at International Meets/events, but which are not conducted by the Sports Federations affiliated or recognized by the International Olympic Committee or by the International Olympic Committee itself, thus appear to become irrevered. Therefore, the irreverence caused to those   internationally   organized   sporting   events,   which   are   notKAVNEET SINGH conducted under the auspices of the Sports Federation, thus affiliated or recognized by the International Olympic Committee or those conducted by   the   International   Olympic   Committee   itself,   but   naturally undermines the sporting calibre or the excellence of performance in those sporting disciplines which are conducted other than by the Sports Federations, as are affiliated or recognized by the International Olympic Committee, besides also  undermines the exemplary sportsmanship exhibited, in those sporting disciplines which may not be organized by the International Olympic Committee itself. Resultantly therebys, the sporting disciplines which are not conducted by the Sports Federation affiliated or recognized by the International Olympic Committee or by the   International   Olympic   Committee   itself,   rather   become discriminated. Therefore, the said discrimination is  to be undone through consideration(s) of the apposite Gradation Certificates, but of scale/level mentioned in the impugned Rules, as made by the authority concerned.

¶27As an illustration, Cricket and other sporting disciplines which may be organized as International meets, and which may not be conducted by the Sports Federation affiliated or recognized by the International Olympic Committee or by the International Olympic Committee itself, therebys rather despite sporting excellence or high benchmark sporting caliber being thereins possessed by the aspirants concerned,   thus   would   remain   untenably   undermined.   Resultantly therebys the irreverence shown to the excellence achieved in such sporting events by the aspirants concerned, would also lead to loweringKAVNEET SINGH the morale of such sportsmen, thus with a concomitant ill effect, that the   standards   of   sporting   excellence   achieved   in   other   sporting disciplines, than as stated in Rule 2(a)(d)(iii) (supra) rather would also suffer erosion. In sequel, the said discrimination is violative of Articles 14 and 16 of the Constitution of India and as such is required to be read down so as to also include the (supra). Therefore, even if sporting excellence in terms of the scale/level mentioned in the Rule (supra) is achieved by the aspirant concerned, through his/her bagging gold, silver or bronze medals at International events conducted by the sporting organizations other than by the Sporting Federations affiliated or recognized by the International Olympic Committee or by the International Olympic Committee itself, thus would also make such an aspirant to be eligible for claiming the benefit of reservation in the sports quota.

28.  Though the learned counsel for the petitioner argues, that Rule 2 (d)(a)(ii) (supra) to the extent that it requires, the aspirant to bag gold, silver or bronze medals in Senior National Championship, in team or in individual events, thus thereby makes the same to create an irrational, arbitrary and invidious discrimination, rather qua age(s) of participation(s) of the aspirant concerned, but the said argument is rudderless.

29.  The reason for making the said conclusion arises from the factum that the learned counsel for the petitioners, has not borne in mind that the word 'Or' intervenes "Senior National Championship" and  "National Games in team or individual events".  ResultantlyKAVNEET SINGH therebys facilitation is endowed even vis-a-vis those aspirants who participate in sporting disciplines, at ages lesser than the age required for participation in Senior National Championship, inasmuch as, if they participate in National Games, therebys the excellence in sporting disciplines exhibited in National Games, thus in individual or team events, but while representing the State of Punjab, but also becomes rewarded.

30.  However, there is a further condition in Rule 2(d)(a)(ii) to the extent that participations by the aspirants concerned, either in Senior National Championship or in the National Games rather is to be rewarded but only when such respective National Sports Federations, thus are affiliated or recognized to the Indian Olympic Association. However, therebys there is evident discrimination in respect of those sporting events which are conducted by those respective National Sports Federations, which however are not  affiliated or recognized to the Indian Olympic Association.

31.  Significantly since the sporting events concerned, thus conducted by the respective National Sports Federation, are to be construed to be in those sporting disciplines which are recognized by the Indian Olympic Association. Therefore, when there may be a large number of sporting disciplines which may not be recognized by the Indian Olympic Association. However, despite the respective Sports Federations, thus conducting sporting disciplines or events, whereins, the sportsmen concerned exhibit exemplary sportsmanship, yet they would remain unrewarded, vis-a-vis their exemplary performance, ofKAVNEET SINGH the scale/level mentioned in the Rule (supra) rather merely on the ground   that   the   Sports   Federations   concerned,   who   organize   the sporting  disciplines/events  are not affiliated  or recognized to  the Olympics. Resultantly the said condition is required to be read down so as   to   also   include   those   sporting   disciplines   organized   by  those Sporting Federations, which are even not affiliated or recognized to the Indian Olympic Association. Necessarily therebys those sporting events which do not become enlisted with the Indian Olympic Association, but would become rewarded vis-a-vis, the excellence in sporting standards becoming achieved thereins, by the aspirants concerned.

¶32The ill effect thereof, would be as stated (supra), qua discouragement percolating in the minds of those sportsmen, who despite achieving excellence in the sporting discipline concerned, yet their excellence being untenably discarded, thus reiteratedly merely for non enlistment of the said sporting discipline, with the Indian Olympic Association, to which the National Sports Federation concerned, are to be affiliated. To overcome the said percolation of discouragement in the mind set of the sportsmen concerned, the impugned Rules, inasmuch as, they ill revere those sporting disciplines which are not enlisted with the Indian Olympic Association, but whereins irrespective of age, the aspirant thus participates in the 'Senior National Championship' or in 'National Games', besides baggs gold, silver or bronze medals either in team   or   individual   events,   thus   are   required   to   be   read   down. Resultantly the appositely excluded sporting disciplines, whereins, the aspirant has excelled in the scale/level mentioned in the Rules (supra) are also to be assigned the benefit of the sports reservation quota.

¶33Reiteratedly, strikingly since cricket and other sporting disciplines are not a part of the Olympiad nor prima facie appear to be recognized by the International Olympic Committee nor is organized by the International Olympic Committee itself, thereupons, if cricket or those sporting disciplines, which are not a part of the Olympiad and/or not recognized as such by the International Olympic Committee rather would ill debar the calibre exhibited thereins or the said may go unrequited. Reiteratedly, therebys the excellence displayed in the said discipline or other alike disciplines, may go untenably unrewarded. The above is to be avoided by the hereinabove direction(s) being passed.

¶34Moreover, reiteratedly if cricket is also not organized by any National Sports Federation, as are affiliated or recognized to the Indian Olympic Association, thereby the discipline of cricket would remain   unrewarded   and/or   the   cricketers,   would   fail   to   receive recognition for their sporting talent. Likewise there may be other sporting disciplines which though remain un-recognized or remain un-conducted by the (supra), rather also may be unequally treated.

35.  Be   that   as   it   may,   the  conditions   in   the   recruitment advertisement(s)(supra) stipulating that the gradation list/certificate, has to   be   in   almost   synchrony   with   the   date   of   issuance   of   the advertisement, thereby in case the Gradation Certificates, rather relate to an era much earlier to the issuance of the advertisement, thereby such Gradation lists, thus are required to be excluded. The reason being thatKAVNEET SINGH excellence in sporting has to be in continuum and/or has not got to pause. If there is an immense gap since the issuance of the Gradation list upto the issuance of the advertisement, therebys when there is but a pause or cessation in the earlier achieved excellence in the sporting standards, but of a scale or level mentioned in the Rules (supra) thereby when the holistic purpose for rewarding excellence becomes grooved in continuity of exhibition of exemplary sportsmanship, in the sporting discipline concerned. Contrarily, if there is a pause in the achieving of excellence in the sporting discipline, thus for a considerable period of time, therebys the Gradation Certificates relating to a period much earlier to the issuance of advertisement, thus are required to be irrevered as tenably done by the respondent concerned, vis-a-vis the instant writ petitioners.

¶36Though the learned counsel for the petitioner(s) has argued that there is a discrimination in respect of those players who participate in Senior National Championship, vis-a-vis, those who participate in State and District Championship, inasmuch as, the former is eligible for Class I and Class II posts and the latter is eligible for Class III and Class IV posts and as such there is invidious discrimination, besides an unreasonable classification, but the said argument is required to be rejected. The reason for forming the above conclusion stems from the factum that there is a distinction between National Sporting events and those which are organized at State and District level. If so, the reward has also got to be distinct. Resultantly when exemplary participation in Senior National Championship or National Games, thus makes theKAVNEET SINGH aspirant concerned to be eligible for seeking the reservation quota for Class I and II posts, therebys the said created eligibility is well rewarded besides is non discriminatory vis-a-vis, participations by those aspirants rather in State and District Championship(s), who contrarily are aptly made eligible for seeking the reservation quota for Class III and Class IV posts. Final Order of this Court.

¶37In aftermath, with the observation(s) aforesaid, the writ petition(s) are disposed of. The reading down (supra) of the impugned amendment as made to Rule 2(d)(a)(ii) & (iii) of the 1988 Rules, through the 2020 Rules, thus is required for enabling parity and non discrimination. Further, the impugned Annexures, appertaining to the respective recruitment advertisement(s), as challenged by the respective petitioner(s) in the writ petition(s) (supra) are maintained and affirmed.

¶38In addition, vis-a-vis sportings excellence achieved in sports disciplines mentioned (Supra), but in the level or scale as mentioned   in   the   Rules   (supra),   be   hereafter   considered   by   the respondent concerned for rewarding theretos the benefit of reservation in the sports quota.

¶40Since the main case(s) itself has been decided, thus, all the pending application(s), if any, also stand(s) disposed of. (SURESHWAR THAKUR) JUDGE (SUDEEPTI SHARMA)
