Sir, regarding the above subject I request that I am Virpal Kaur wife of Sh. Gurmeet Singh resident Dashmesh Nagar Jalalabad District Fazilka etc. That I met Nirmala Rani abovesaid at some wedding, who described herself as a finance worker. As I needed money, I agreed to take a loan from her side. Upon which she told me about the loan given by the Modi government and said that for this you have to make about members and all of them will get a loan from the government. 43 members were made and 60 lakh rupees were collected by all of us and deposited in different accounts of the persons under the said subject, the proof of which is available with us, and I am ready to present it as evidence on the spot. After which we have been harassed by the persons under the said subject for almost 2 years and they kept lingering on and neither our loan pass nor our principal amount is being refunded to us. We were deceived by the abovesaid and they asked for one and a half lakh rupees per person to pass the loan and then we gathered our relatives and some friends and with that we have got 43 members together, to whom they had to get the loan passed. Among them, few were very poor and they could not pay this money at the first instance, and then as the money was being collected, Nirmala Rani, wife Krishna Lal, kept coming and taking money from our house from time to time as we sold the combine and in this way also gave some money from our accounts, thus kept on depositing about 45 lakh rupees in their accounts online. Accounts in which 94171-39364, Manpreet Singh's account 94170-28076, Devinder Kaur Brar and 70557-57354, Sanjeev Kumar 98721-13974, Vijay Kumar (the details of which we can present as evidence. And then these persons kept on linger on us for almost 2 years, and we are having their phone recordings and we can present it as evidence. From this, the money of some persons has been returned by Veerpal Kaur at her own level by selling her house and articles of her house. Apart from me and 43 members, some other persons have been cheated by them of around Rs. 20 lakhs. Abovesaid persons now are threatening us and no one is picking up our phone. Abovesaid persons are now absconders and we do not know their whereabouts and the addresses given by them where they were staying, now they are not available there. Please take strict action against abovesaid persons as they had made a gang and had cheated different persons for amount of about Rs. 80 lakhs and for deceiving us and our money be got returned. We all members belong to poor families and this amount is too big for us, due to which we are suffering financially and mentally. So please take action against abovesaid persons as soon as possible and our claim be satisfied. We shall be very grateful. On behalf of the respondent/State Mr. Jaspal Singh Guru, AAG Punjab, appearing on advance notice prays for dismissal of the present petition on the ground that the allegation against the present petitioner(s) are serious in nature, therefore, custodial interrogation of the petitioner(s) is required. Mr. Kanwaljeet Singh Brar, Advocate has put in appearance on behalf of the complainant and has filed Power of Attorney, which is taken on record. He prays for dismissal of the present petition on the ground that petitioner(s) in connivance with other co-accused has concealed their real identity and was prepared fake skill certificates, therefore, committed fraud of Rs.86 lacs.
¶4Analysis This court cannot ignore that prima facie the offence against the petitioner(s) can be made out as they in connivance with other co-accused persons has concealed their identity, prepared fake skill certificates and therefore, committed fraud of Rs.86 lacs with the members by alluring these members with getting subsidy of Rs.5-7 lacs in the Indian Government Scheme of Rs.15-20 lacs. Hence, prima-facie offence under Section 419, 420, 465, 467, 468, 471, 120-B are made out against the petitioner(s). Such an allegation certainly requires adequate and intense investigation to unearth the truth. The mere contention that the petitioner(s) are ready and willing to join the investigation does not vest a right for grant anticipatory. The case made out against the petitioner(s) is certainly a relevant ground for denial of anticipatory bail in the case in hand at this stage. The Hon'ble Supreme Court in the case of Sumitha Pradeep Vs. Arun Kumar C.K. & Anr. 2022 Live Law (SC) 870 held that merely because custodial interrogation 9as not re;uired b) itself could not be a ground to grant anticipator) bail. !he first and the fore6ost thing the "ourt hearing the anticipator) bail application is to consider is the pri6a facie case against the accused. !he relevant e=tract of the judg6ent is reproduced hereinbelo9:2 >It may be true, as pointed out by learned counsel appearing for Respondent No.1, that charge-sheet has already been filed. It will be unfair to presume on our part that the Investigating Officer does not require Respondent No.1 for custodial interrogation for the purpose of further investigation. Be that as it may, even assuming it a case where Respondent No.1 is not required for custodial interrogation, we are satisfied that the High Court ought not to have granted discretionary relief of anticipatory bail. We are dealing with a matter wherein the original complainant (appellant herein) has come before this Court praying that the anticipatory bail granted by the High Court to the accused should be cancelled. To put it in other words, the complainant says that the High Court wrongly exercised its discretion while granting anticipatory bail to the accused in a very serious crime like POCSO and, therefore, the order passed by the High Court granting anticipatory bail to the accused should be quashed and set aside. In many anticipatory bail matters, we have noticed one common argument being canvassed that no custodial interrogation is required and, therefore, anticipatory bail may be granted. There appears to be a serious misconception of law that if no case for custodial interrogation is made out by the prosecution, then that alone would be a good ground to grant anticipatory bail. Custodial interrogation can be one of the relevant aspects to be considered along with other grounds while deciding an application seeking anticipatory bail. There may be many cases in which the custodial interrogation of the accused may not be required, but that does not mean that the prima facie case against the accused should be ignored or overlooked and he should be granted anticipatory bail. The first and foremost thing that the court hearing an anticipatory bail application should consider is the prima facie case put up against the accused. Thereafter, the nature of the offence should be looked into along with the severity of the punishment. Custodial interrogation can be one of the grounds to decline custodial interrogation. However, even if custodial interrogation is not required or necessitated, by itself, cannot be a ground to grant anticipatory bail." More so, investigation is still going on in the present case. +t is settled proposition of la9 that po9er e=ercisable under Section #7$ "r.P."., is so6e9hat e=traordinar) in character and it is to be e=ercised in e=ceptional cases. !he Supre6e "ourt in "State vs. Ani Sharma!" (#$$7) 7 SCC #87% held as under:2 "We find force in the submission of the CBI that custodial interrogation is qualitatively more elicitation oriented than questioning a suspect who is well ensconded with a favourable order under Section 438 of the code. In a case like this effective interrogation of a suspected person is of tremendous advantage in disinterring many useful informations and also material which would have been concealed. Success in such interrogation would elude if the suspected person knows that he is well protected and insulated by a pre-arrest bail order during the time he is interrogated. Very often interrogation in such a condition would reduce to a mere ritual. The argument that the custodial interrogation is fraught with the danger of the person being subjected to third-degree methods needs not be countenanced, for, such an argument can be advanced by all accused in all criminal cases. The Court has to presume that responsible police officers would conduct themselves in a responsible manner and that those entrusted with the task of disinterring offences would not conduct themselves as offenders." +n vie9 of the seriousness of the allegations as also the need to ta(e the investigation to its logical conclusion, the custodial interrogation of the petitioner(s) is certainl) re;uired. !herefore, + find no 6erit in the instant petitions, hence, the sa6e are hereb) dis6issed. :o9ever, it is 6ade clear that the observations in this order are onl) for the purposes of deciding this bail application and the trial "ourt is free to adjudicate upon the 6atter in accordance 9ith la9.
