¶3Contentions On behalf of the petitioner Learned counsel for the petitioner has argued that the petitioners have been falsely implicated in this case and the petitioners were neither beneficiary nor any transaction took place between the petitioners and the complainant. As per the allegations, on account of sending one Mani Singh abroad, Rs. 5.5 lakhs were given in cash to main accused Jasleen Kaur who has already been granted concession of anticipatory bail vide order dated 08.08.2024 passed in CRM-M-38403-2024. On behalf of the State Learned State Counsel appearing on advance notice onAnuradha CRM-M-51131-2024 13 instructions from SI Balwainder Singh vehemently opposes the prayer for grant of concession of anticipatory bail on the grounds that the petitioners in connivance with other co-accused duped the complainant on the pretext of sending him abroad. He candidly admits that no recovery is to be effected from the petitioners and on that account interrogation is not necessary and he is not in a position to controvert the submissions made by counsel for the petitioners that the main accused-Jasleen Kaur to whom the payment was made against the promise as alleged in the FIR has already been granted the concession of anticipatory bail. On behalf of the complainant Mr. G.S. Verma, Advocate, puts in appearance on behalf of the complainant and has filed his Power of Attorney in Court, which is taken on record. Learned counsel appearing on behalf of the complainant, in addition to the submissions made by learned State counsel, would contend that in fact 9600 Dirham which comes to Rs. 2,86,655/- if converted into Indian currency was asked to be payed to Gagandeep Singh, (petitioner No.2), therefore, they do not deserve the concession of anticipatory bail.
¶4Analysis Be that as it may, neither the State Counsel nor the counsel for the complainant could make out a case for custodial interrogation as no amount is to be recovered from the petitioners nor any incriminating material whatsoever against the petitioners has been produced. Even a perusal of the present FIR does not reveal a case that the petitioners are CRM-M-51131-2024 14 required to be taken into custody for interrogation for any specific question, wherein the counsel for the petitioners otherwise undertakes that the petitioners will join the investigation once the Court grants protection and would co-operate with the investigating officer as and when called upon for the conclusion of the enquiry.
¶5Decision Looking into the totality of the circumstances and the nature of allegations and in view of the fact that the main accused has already been granted concession of anticipatory bail by this Court as well as considering the undertaking given by the petitioners, they are hereby directed to be released on anticipatory bail subject to their joining investigation and reporting to the Investigating Officer concerned within a period of one week from today, on furnishing of personal/surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioner shall also abide by the terms and conditions as envisaged under Section 482(2) of BNSS of which are reproduced below :-'When the High Court or the Court of Session makes a direction under sub-section (1), it may include such conditions in such directions in the light of the facts of the particular case, as it may think fit, including-
(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; CRM-M-51131-2024 15
(iii) a condition that the person shall not leave India without the previous permission of the Court;
(iv) such other condition as may be imposed under sub-section
(3) of section 480, as if the bail were granted under that section.' However, it is made clear that in case the petitioners do not comply with the aforesaid direction of joining the investigation within one week, the order passed by this Court today shall automatically stand cancelled. The petition in the aforesaid terms stand allowed. (SANDEEP MOUDGIL) JUDGE
