Learned Senior Counsel, Mr. Somik Deb assisted by Learned Counsel, Mr. Debasish Datta is present for the applicant. Learned Counsel, Mr. Samarjit Bhattacharjee appeared on behalf of the respondents.
At this stage, Learned Senior Counsel, Mr. S. Deb referring the contents of the order dated 29.11.2024 passed by a coordinate bench of this High Court in I.A. No.01 of 2024 arising out of Review Pet. No.30 of 2023 (D/O) drawn the attention of the Court that, as per order of the Court, the respondent-ONGC has deposited an amount of Rs.49,78,553/- in the respective bank account of both the minor daughters of late Tushar Kanti Debbarma and it was further directed by this Court to the Manager, State Bank of India, Jampuijala Branch, Code No.61142 not to disburse the amount in favour of the minor daughters till their attaining the age of majority until and unless prior permission is obtained from this Court by the natural guardian and by that order the case was disposed of.
Now, the wife namely Smt. Shibani Debbarma of late Tushar Kanti Debbarma being the natural guardian of minor daughters namely, Miss Rashika Debbarma and Miss Tanvi Debbarma who are
facing several financial hardships has filed the application. In Para No.10 of the application it is stated that both the minor daughters are pursuing their studies in Class-VIII and Class-IV and the applicants have no residence of their own at Agartala and their houses have been damaged due to sudden flood and as such, the applicants are facing severe hardships in absence of their father.
Learned Senior Counsel submitted that, if a considerable amount is not released in favour of the applicants, then, it would be very difficult on their part to come out from the crisis. So, Learned Senior Counsel urged for passing appropriate order.
Considered.
It appears that, as per order dated 29.11.2024 passed by this Court in connection with case No.I.A. 1/2024 arising out of Review Pet. 30/2023 (D/O) Rs.49,78,553/- was transferred by ONGC to the respective accounts of the minor daughters of deceased Tushar Kanti Debbarma with a direction to the bank not to disburse the amount until the minors attain majority and until and unless permission is obtained by the natural guardian. Since, the mother, Shibani Debbarma is the natural guardian of the minor applicants so for the sake of convenience, it is ordered that a sum of Rs.17,00,000/- (Rupees seventeen lakhs) be kept in Fixed Deposit Certificate in the name of minor daughters each till attaining their majority after procuring their birth certificate by the Branch Manager, State Bank of India, Jampuijala Branch, Code No.61142 and the balance amount after deducting Rs.34,00,000/- (Rupees thirty four lakhs) be released in favour of the natural guardian, the mother of the applicants namely Smt. Shibani Debbarma for the purpose of meeting out the welfare expenditures of the applicants. The applicants may accordingly approach to the bank along with a copy of this order.
Let a copy of this order be supplied to Learned Senior Counsel appearing for the applicants for information and necessary action.
With this observation, the present I.A. stands disposed of.
