Order
05/09/2024
Heard Mr. S. Sarkar, learned senior counsel assisted by Ms. A. Saha Hirawat, learned counsel appearing for the applicants. Also heard Mr. Raju Datta, learned PP appearing for the respondent-State. Both the accused-persons, namely, Jibanjoy Tripura and Selenjoy Tripura, were arrested on 15.04.2024 in connection with Birganj PS case no. 2024/BRG/010 for allegedly committing offences punishable under Sections 21(b)/29 of the NDPS Act, 1985. The principal allegation against both the accused persons is that they were carrying intermediate quantity of drugs. They were arrested and were detained in custody for 112 days since
15.04.2024. Under Order dated 05.08.2024, this Court had granted them interim bail. While this Court granted bail to the accused persons, a condition was imposed that both the accused persons would start anti-drug campaigning in and around the areas where they reside, from the date when they would be enlarged on interim bail. The police officials were also directed to submit report about the conduct of the accused persons. Today, when the matter came up, learned PP has placed a report alongwith some photographs and a pen drive submitted by the Police Officers in connection with the instant case. I have perused the report wherefrom it is revealed that both the accused persons had actively conducted anti-drug campaigning in and around their areas. It is further revealed from the photographs as well as from the report that the anti-drug campaigning undertaken by the accused persons and their family members in and around their areas had a substantial impact upon the localized of those areas. The main purpose of undertaking anti-drug campaigning in those areas is to increase the awareness amongst the people about the menace of using drugs. Since the accused persons as well as their family members under the previous order had conducted anti-drug campaigning regularly in and around their areas, and keeping in view the fact that, both the accused persons were carrying intermediate quantity of drugs, this court has reasonable belief that the accused persons would not be involved in respect of trading/ peddling of drugs in future in any manner personally. Accordingly, the interim bail granted to the accused persons vide Order dated 05.08.2024 have been confirmed and is made absolute. Resultantly, both the accused persons, namely, Jibanjoy Tripura and Selenjoy Tripura, shall be released on bail on executing a bond of Rs. 50,000/- each with one surety each of the like amount to the satisfaction of the learned Special Judge (NDPS), Gomati Judicial District, Udaipur. The report dated 04.09.2024 has been kept on record. This court has made it clear that this order shall not be used as a precedent by any of the courts. With the above observation and direction, the instant bail application stands allowed and thus disposed.
