Mr. Samarjit Bhattacharjee, Advocate.
For Respondent(s) : Mr. Karnajit De, Addl. G.A.
HON'BLE MR. JUSTICE S. DATTA PURKAYASTHA _O_R_D_E_R_
26.08.2025
Heard Mr. Purusuttam Roy Barman, learned senior counsel appearing for the petitioners and Mr. Karnajit De, learned Addl. G.A. appearing for the respondents-State.
With the consent of both sides, the writ petition is disposed of at the admission stage.
The grievance of the petitioners is that they appeared in the T-TET (Paper-II) Examination, 2024, and according to them, in the examination in respect of Paper-II, the answers to the Question Nos.02, 65, 107 and 109 of Question Booklet Series-A (similar to Question Nos.10, 64, 128 and 130 of Series-B and Question Nos.24, 66, 146 and 148 of Series-C), as published in the final answer key were incorrect, and therefore, they are entitled to get full marks against those questions. To justify their claim, they have submitted certain documents in this regard. Learned senior counsel submits that earlier the petitioners have not submitted any representation to respondents No.3 & 4 in this regard and have directly approached the Court. Some of the petitioners have submitted objections to the respondents in this regard challenging the correctness of the answers shown in the answer key regarding those questions. Learned senior counsel further submits that, keeping in mind the decisions of this Court in other similar matters, this matter may also be referred to respondents No.3 & 4 for proper decision, and in this regard, an opportunity may be given to the petitioners to submit representations with relevant documents in support of their claim to respondents No.3 & 4.
Mr. De, learned Addl. G.A., submits that only three petitioners, i.e., Petitioner No.11, Petitioner No.20 and Petitioner No.33, have challenged the correctness of said answers given in answer key by making representations to respondents No.3 & 4, but they have not challenged Question No.65 of the Question Booklet, Series-A. However, learned Addl. G.A. has not opposed the submission of learned senior counsel regarding sending the matter for decision to respondents No.3 & 4 on the representations to be submitted to the petitioners.
Keeping in mind the submissions of both sides, and without observing anything on the merits of the case, the writ petition is disposed of by giving an opportunity to the petitioners to submit proper representations ventilating their grievances, as agitated above regarding said questions with suggested answers along with relevant documents/authorities in support of their claim to the respondents No.3 & 4 within 7(seven) days from today and respondents No.3 & 4 are directed to dispose of their representations with a reasoned order within next 3(three) weeks thereafter.
The writ petition, is accordingly, disposed of with above said terms.
Pending application(s), if any, shall also stands disposed of.
