Judgment
ORDER 04/10//2024
Heard Ms. R. Purkayastha, learned counsel for the petitioner and Mr. Bidyut Majumder, learned Deputy S.G.I for the respondent Nos. 3 and 4.
[2]
Respondents Nos. 3 and 4 have filed an affidavit in opposition. Respondents have issued an office order dated 30.09.2024 rejecting the candidature of the petitioner in accordance with the existing instructions and rules as per the Advertisement Notice F.No.PPI01/11/2022-PP_1 issued by GOI, Ministry of Personnel, Public Grievances and Pension, DoPT, SSC, New Delhi-110003.
[3]
Ms. R. Purkayastha, learned counsel for the petitioner has questioned the grounds of rejection including statements made therein to the effect that the representation made by the petitioner before the Director, CRPF (Central Reserve Police Force) (Recruitment Branch) (respondent No.5 in writ petition) was not received. Therefore, due consideration had not been accorded in the light of the observations made by this Court in the writ petition.
[4]
Mr. Bidyut Majumder, learned Deputy S.G.I for the respondent Nos.2 and 3 submits that the writ petition was disposed of on the first date with certain observations and directions on the basis of the statement made by the petitioner that her representations were pending before the concerned respondent authorities which have not been considered. It is submitted that on both grounds that no such application was received in the office of the Director, CRPF (Central Reserve Police Force) (Recruitment Branch) (respondent No.5 in the writ petition) and on merits also the claim has been rejected by the competent authority. Therefore, there is no violation of the Courts order inviting contempt.
[5]
This Court upon consideration of rival submissions of the parties and after going through the affidavit in opposition is of the considered view that the respondents have issued an office order rejecting the candidature of the petitioner on certain grounds. The merits of the rejection order cannot be gone into in contempt jurisdiction.
[6]
Accordingly, the instant petition is disposed of. Pending application(s), if any, shall also stand disposed of. Petitioner may have liberty to assail the order in an appropriate proceeding.
