The Board of Revenue while directing the parties to maintain the status quo qua the property, which is the subject matter of the proceedings under
Section 176 of the U.P. Z.A. & L.R. Act, pending consideration to be decided by the Court of Assistant Collector as Case No. 1 of 2020-21, Bachan Singh Vs. Kulveer Singh and others, it has been directed the parties to maintain the status quo, and simultaneously, a direction has also been issued to the Assistant Collector to decide the suit within a period of six months from the date of the order. But since, the Writ Petition was preferred, and the same remained pending, the Writ Petition is hereby dismissed.
Because the order impugned dated 28th December, 2021, does not at all prejudice the right of the present petitioner in any manner whatsoever. But, however, dismissing the Writ Petition and maintaining the direction issued by the order passed by the Board of Revenue, the time period granted by the Board of Revenue to the Court of Assistant Collector to decide the suit within a period of six months, the same would start running from today, and it is hoped and trusted that the Assistant Collector would decide the aforesaid Suit, i.e., Case No. 1 of 2020-21, Bachan Singh Vs. Kulveer Singh and others, within a period of six months from today.
