WPCRL/1623/2026

Bhavneet Kaur --Petitioner Versus State Of Uttarakhand --Respondent Hon'ble Alok Mahra, J.

Mr. Prem Kaushal, learned counsel for the petitioner.

¶2Mr. S.C. Dumka, learned A.G.A. along with Mr. Nikhil Bisht, learned Brief Holder for the State.

¶3By means of present writ petition, the petitioner seeks a writ, order or direction in the nature of mandamus commanding respondent nos. 2 and 3 to provide adequate security and protection to the petitioner and further to direct respondent no. 4 not to interfere, in any manner whatsoever, with the life, liberty property of petitioner. The petitioner has also sought a direction to respondent nos. 2 and 3 to consider and decide the representation submitted by her and, consequently, provide adequate protection to her.

¶4Learned counsel for the petitioner would submit that the petitioner is an unmarried woman a permanent resident of the State of Uttarakhand. It is submitted that she is residing alone and is

also looking after and taking care of the properties belonging to her mother and maternal aunts; that, respondent no. 4, who is a relative of the petitioner, along with his associates, has developed an unlawful intention to usurp and illegally grab the properties in question. It is, therefore, contended that the petitioner apprehends a serious imminent threat to her life, personal liberty and property and, being aggrieved thereby, has been constrained to approach this Court seeking appropriate protection.

¶5Learned counsel for the petitioner would further submit that, on previous date, the State was directed to obtain specific instructions with regard to the alleged threat perception to the petitioner.

¶6Learned State counsel, on the basis of written instructions received from the In-charge of the concerned Police Station, would submit that there exists a long-standing dispute between the petitioner and respondent no. 4 in respect of the land/property in question upon making an inquiry from the neighbouring persons residing in the vicinity, the police authorities found that a dispute regarding said land has been continuing between the parties for a considerable period. It is further submitted that, in relation to the said dispute, the police authorities have already initiated appropriate preventive proceedings by preparing a challan under Section 164 of the B.N.S.S.. Learned State counsel has

also placed before the Court the written instructions received from the In-charge of the concerned Police Station.

¶7The written instructions furnished by the In-charge of the concerned Police Station are taken on record.

¶8Upon perusal of written instructions, this Court finds that the police authorities have made an inquiry into the alleged threat perception and have taken note of the existing land dispute between petitioner respondent no.

¶4The written instructions, however, do not disclose any specific or imminent threat to the life or personal liberty of petitioner warranting issuance of any further direction by this Court at this stage.

¶9In view of the aforesaid facts and circumstances, and having regard to the written instructions placed before the Court by learned State counsel, no further orders are called for. Accordingly, the writ petition stands disposed of.

¶10The written instructions are taken on record.

¶11Registry is directed to paginate the written instructions and place the same on the record.

¶12Pending applications, if any, also stand disposed of.
