Bharatiya Nagarik Suraksha Sanhita, 2023 · Chapter XVIII: The Charge · B.—Joinder of charges

Section 245: When offence proved included in offence charged

Earlier law: CrPC section 222 (When offence proved included in offence charged)

In plain words

A person charged with an offence can be convicted of a minor offence included in it, if only some of the particulars are proved or facts proved reduce it to a minor offence, even though the minor offence was not charged. They can also be convicted of attempting the charged offence.

  • This does not allow conviction of a minor offence where the legal conditions for starting proceedings for it (such as a complaint or sanction) were not met.

Example: A is charged with causing grievous hurt and proves he acted on grave and sudden provocation. He can be convicted of the lesser provocation offence.
