Code of Criminal Procedure, 1973 · Chapter XXI: Summary Trials
Section 262: Procedure for summary trials
The Code of Criminal Procedure, 1973 was repealed and replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023 from 1 July 2024. It still applies to offences and proceedings from before that date.
(1) In trials under this Chapter, the procedure specified in this Code for the trial of summons-case shall be followed except as hereinafter mentioned.
(2) No sentence of imprisonment for a term exceeding three months shall be passed in the case of any conviction under this Chapter. 1. Subs. by Act 25 of 2005, s. 23, for —two hundred rupees‖ (w.e.f. 23-6-2006). 2. Subs. by s. 23, ibid., for —criminal intimidation‖ (w.e.f. 23-6-2006).
Corresponding sections were matched by comparing the wording of both official texts, and for the IPC and BNS, also against a published correspondence table. Wording, punishments and structure often changed, so read both sections before relying on the match.
